Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and Bellevo, Inc. ("Bellevo", "we", "us"). They govern your access to and use of the Bellevo mobile app, the Bellevo for Business mobile app, the bellevoapp.com website, and any related services (together, the "Service"). By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. The Service

Bellevo is a marketplace that connects customers with independently-owned salons and beauty professionals ("Salons"). The Bellevo app lets customers discover Salons, book appointments, and pay for services. The Bellevo for Business app lets Salons manage their listings, calendar, services, clients, and payments.

Bellevo is not the provider of the services that you book. Each appointment is a contract between you and the Salon. We facilitate the booking, payment, and communication around it, but the Salon is responsible for the services it delivers, the people it employs, and the policies it sets.

3. Eligibility

You must be at least 18 years old to create a Bellevo account, or the age of majority in your jurisdiction if greater. By using the Service you represent that you meet this requirement and have the legal capacity to enter into these Terms.

4. Accounts

To use most features of the Service you need to create an account by signing in with Apple, Google, or email and password. You agree to:

• Provide accurate, current, and complete information.
• Keep your sign-in credentials confidential and notify us right away at hello@bellevoapp.com if you suspect unauthorized access.
• Be responsible for all activity that occurs under your account.

You may delete your account at any time from inside either app under Profile → Account → Delete account. Deletion is immediate and permanent. See our Privacy Policy for details on what is removed.

5. Bookings and Cancellations

When you confirm a booking through the Service:

• You agree to arrive on time, follow the Salon's reasonable health and safety guidance, and pay the price quoted at the time of booking (plus any applicable taxes).
• Each Salon sets its own cancellation, no-show, deposit, and refund policy. The policy is shown to you before you confirm. By confirming the booking, you accept that Salon's policy.
• If you need to cancel or reschedule, do so through the app as soon as possible. Late cancellations and no-shows may be charged in accordance with the Salon's policy.
• If a Salon cancels on you, we will make a reasonable effort to notify you and help you find another time or salon. Refunds for Salon-initiated cancellations are handled according to the Salon's policy.

6. Payments and Fees

The Service uses third-party payment processors (currently CyberSource) to handle card payments. By making a payment through Bellevo you agree to the processor's terms and authorize Bellevo and the Salon to charge the payment method you provide for the booking amount, taxes, tips, and any cancellation or no-show fees permitted by the Salon's policy.

Bellevo may charge Salons commissions, subscription fees, or transaction fees for using the Bellevo for Business app. Those fees are set out in a separate agreement between Bellevo and each Salon. Customers do not pay Bellevo any booking, convenience, or service fees beyond the price quoted by the Salon and any taxes.

All prices are quoted in local currency. Refunds, when issued, are returned to the original payment method.

7. Salon Responsibilities

If you operate a Salon on Bellevo, you additionally agree to:

• Hold all licenses, registrations, and permits required to operate your business in your jurisdiction.
• Maintain accurate listings, including service descriptions, prices, opening hours, and cancellation policies.
• Honor confirmed bookings, communicate professionally with customers, and provide services as described.
• Handle customer personal data only for the purpose of delivering the booked services and in accordance with applicable privacy laws.
• Be solely responsible for the services you deliver, your staff, and any disputes or claims arising from those services.

8. User Content

You may upload photos, descriptions, reviews, and other content to the Service ("User Content"). You retain ownership of your User Content. By submitting it, you grant Bellevo a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content as needed to operate and promote the Service. You represent that you own or have the necessary rights to the User Content you upload and that it does not infringe anyone else's rights.

9. Acceptable Use

You agree not to:

• Post content that is unlawful, abusive, harassing, hateful, defamatory, sexually explicit, or misleading.
• Impersonate another person, salon, or Bellevo employee.
• Scrape, copy, or harvest data from the Service without our written permission.
• Interfere with, probe, or attempt to disrupt the operation, security, or integrity of the Service.
• Use the Service to send spam, malware, or other harmful content.
• Use the Service to compete with Bellevo, build a competing product, or for any other purpose not expressly permitted by these Terms.

10. Intellectual Property

The Bellevo name, logo, app designs, source code, and any content we provide are owned by Bellevo, Inc. or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service for its intended purpose. No other rights are granted by implication.

11. Third-Party Services

The Service depends on third-party services such as Apple, Google, Firebase, Google Maps, and our payment processor. Their availability and behavior are outside our control, and you agree that we are not responsible for any issues caused by third-party services. Their separate terms and privacy policies apply to your use of them.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, BELLEVO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

BELLEVO MAKES NO WARRANTY ABOUT THE QUALITY, SAFETY, OR LEGALITY OF THE SERVICES OFFERED BY ANY SALON ON THE PLATFORM. ANY DISPUTE BETWEEN YOU AND A SALON IS SOLELY BETWEEN THE TWO OF YOU.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BELLEVO AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BELLEVO IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.

14. Indemnification

You agree to indemnify, defend, and hold harmless Bellevo and its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your User Content, or (d) your violation of any law or the rights of a third party.

15. Termination

You may stop using the Service at any time and delete your account from inside the app. We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms, created risk or possible legal exposure for Bellevo, or for any other reason permitted by law. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability, indemnification, and governing law — will survive.

16. Governing Law and Disputes

These Terms are governed by the laws of the Federation of Saint Christopher and Nevis (Saint Kitts and Nevis), without regard to its conflict-of-law principles. Any dispute arising from or related to these Terms or the Service will be brought exclusively in the courts of Saint Kitts and Nevis, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, you and Bellevo each waive the right to a jury trial.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material we will give you reasonable notice in the app or by email before they take effect. Continued use of the Service after the changes take effect means you accept the updated Terms.
